Agreement of Use (compulsory)

Chapter 1. General Provisions

Article 1. Purpose
This provision has the purpose of prescribe the authority, obligation, and responsibility of the clinic and users for using services on internet web pages that Loving Care Clinic (hereafter "Clinic") provides.

Article 2. Validity and Change of Provision
(1) This provision shows the validity from the notification through services.
(2) If Clinic has inevitable situation, it may revise the provision, and the changed provision shall be announced at leat 2 days prior of revision and shows validity from the announcement or notification as the same way from the Clause 1.
(3) If the member does not agree to the changed provision, he/she may request to withdraw from the membership. And if he/she uses services even after the effective date of the changed provision, it is considered he/she agrees to the change.

Article 3. Rules concerning subjects other than the provisions
For the subjects that are not mentioned on the provisions, interpretation of them may be followed by the relavant laws such as the Basic Act on Telecommunications, the Telecommunications Business Act, and the Act on Promotion of Information and Communications Network Utilization and Information Protection, Etc. 

Article 4. Definitions of Terms
(1) "Member" is the person who agrees to use services from Clinic and receives user ID and password.
(2) "ID" is letters,, numbers, or combination of those that the member determines and Clinic approves, and that is used to identify user and for the member to receive services from Clinic.
(3) "Password" is a combination of letters and numbers determined by the member to confirm tha he/she is the one the ID is given and to protect the member's personal information. 
(4) "Termination" refers to the end of the service contract by the member after using services.

Chapter 2. Membership Registration and Use of Services

Article 1. Establishment of Contract of Use
(1) Members are limited to domestic residents only.
(2) Members are limited to individuals. Companies, organizations, or corporations may not register as members.
(3) Membership is established by Clinic's approval to the user's application for use and user's consent to the agreement contents. 
(4) If a user clicks "I agree" after reading this agreement, the contents of this agreement will be considered recognized and agreed.

Article 2. Application for Use
Those who wish to register as members and use services apply for use by providing personal information according to the prescribed form set by Clinic.

Approval on Application for Use
(1) Clinic accepts the application for use in the order of receipt unless there are special circumstances for the application for use under Article 2 of Chapter 2.
(2) Clinic may restrict the approval on application for use for any of the following cases and may reserve the approval until the reason is resolved.
① Where there is no room for the service-related facilities.
② Where there are any technical challenges.
③ Where it is deemed necessary due to other Clinic's circumstances.
(3) Clinic may not accept request for membership from the person of the following cases.
① Who requests for registration using other person's name.
② Who requests for registration using false name.
③ Who records false information on the registration form.
④ Who requests on the purpose of hindering the well-being and order of society, or the good manners and customs.
⑤ Who requests with insufficient requirements for application for use prescribed by Clinic
(4) If the consent of the application for use is withheld or not accepted pursuant to para 2 or 3, Clinic shall notify the applicant it. However, the exception is if the applicant may not be notified without any reason attributable to Clinic.

Protection of Personal Information
(1) Clinic protects and respects members' personal informatioon.
(2) Clinic compiles members' information provided by members to participate in community activities or various events, and through information collected from the other processes of using services. Members' personal information is used for the purpose of performing this agreement and providing services under this agreement.
(3) Clinic may not provide, spill, or distribute members' personal information otained for providing services to the third-party without consent of members. However, the following exceptions shall apply. 
① Where it is needed for the billing on providing information and communication service
② Where it is provided in individually unidentified processed form to conduct for statistic analysis, academic study, or market survey
③ Where there is a request from the relevant agency in accordance with the procedures and methods determined for the purpose of investigation by the relevant statutes
④ Where specific regulation on legal issue exists
⑤ Where the Information and Communication Ethics Committee requests
(4) Clinic may provide personal information to the third-party with consent of the users in the following cases. Even in these cases, the provision of personal information to the third-party is only with consent of the users, and those who don't want his/her personal information to be provided, it shall not be needed to use specific services or participate in specific types of promotions or events.
① Where the users have agreed in advance
② Where it is pursuant to the provisions of statutes, or is requested by an investigative agency in accordance with the procedures and methods prescribed in statutes for the purpose of investigation
(5) When personal information is provided or shared, the consent shall be obtained by notifying individually by e-mail or in written form about  which organization and institution is provided to, what items of personal information are provided or shared, why such personal information should be provided and shared, and until when and how it is protected and managed. If the consent from a member is not obtained, his/her personal information shall not be provided to or shared with the organization and institution.
Moreover, the members may withdraw their consent at any time for the consent of provision to the third-party.
(6) Within the range of para 3, Clinic may create and use collective statistical data on all or part of the members' personal information related to Clinic's work and may transmit cookies to the members' computer through services. In this case, the members may refuse to receive cookies or change the settings to warn on receiving cookies in the browser on the computer.
(8) Clinic endeavor to protect users' personal information including registration information as prescribed by other laws and regulations. The protection of users' personal information is pursuant to the related statutes and "Personal Information Protection Policy" prescribed by Clinic. 

Chapter 3. Obligations of Contracting Parties

Article 1. Obligation of Clinic
(1) Clinic shall allow members to use services unless there are special circumstances.
(2) Clinic shall consistently endeavor to provide continuous and stable services as prescribed in this agreement, and shall repair and restore facilities without delay when they fail or are lost. However, in case of natural disaster, emergency, or other unavoidable circumstances, services may be suspended temporarily or halted.
(3) When Clinic deems the opinions or complaints raised by the members through the prescribed procedure are fair, it shall handle them duly. When it takes a certain period of time to process, the members should be informed of the reason and the processing schedule.
(4) Clinic shall protect members' privacy as described in Article 4, Chapter 2.
(5) Clinic shall endeavor to provide the users convenience in terms of procedures and contents related to the contract such as conclusion of use contract, changes and cancellation of the contract, etc. 

Article 2. Obligation of Members
(1) Members shall comply with the matters informed or notified by Clinic, such as the provisions prescribed in this agreement, and services use guideline or precautions, and shall not engage in any other acts that interfere with Clinic's work. 
(2) All the responsibility of management concerning ID and password shall be on members. Members shall be responsible for all consequences arising from the negligence of managing and wrongful use of granted ID and password.
(3) As a member recognizes that his/her ID or password has been used wrongfully, the member must report it to Clinic immediately and the member is responsible for all consequences of not reporting it.
(4) Members shall comply with the restrictions on use that Clinic posts in the bulletin board of service or announces separately.
(5) Members may not engage in business activities using services without prior approval from Clinic, and Clinic shall not be responsible for the consequences of the business activities and the results of members' activities in violation of the agreement. When Clinic suffers damage due to such business activities, the member is obligated to compensate Clinic for the damage.
(6) Members shall not transfer or give the right to use services or any other contractual status to someone else without Clinic's express consent, and shall not provide it as collateral.
(7) Members shall not engage in any of the following acts in respect of use of services.
① Acts of stealing another member's ID and password
② Acts of duplicating of information obtained through services on the purpose of other than members' use without prior approval of Clinic, or using it for publication, broadcast, etc., or providing it to the third-party.
③ Acts of distributing infringement of another person's patents, trademarks, business secrets, copyrights, and other intellectual property rights to others by posting, e-mailing, or other means.
④ Acts of distributing information, sentences, shapes, etc. of vulgar, obscene content violating of public order and the good manners and customs to others by transmitting, posting, e-mailing, or other means.
⑤ Acts of distributing others insulting or threatening content which may infringe on the privacy of others by trasmitting, posting, e-mailing, or other means.
⑥ Acts objectively judged to be associated with a crime
⑦ Acts of collecting or storing other users' personal information without Clinic's approval
⑧ Other acts violating relevant Acts and subordinate statutes

Chapter 4. Use of Member Services

Article 1. Charges, Information with Fee, and Payment
(1) Services are available free of charge to anyone registered as members.
(2) When Clinic makes its services pay-per-use, the timing, policy, and cost of charging must be published before charging is executed.

Article 2. Provision of Information
(1) Clinic may provide members with various information deemed necessary while using services by announcements or e-mails.
(2) To provide members better service benefits, Clinic may provide information related to services (medical science, medical treatment) via various delivery methods (phone calls, notices, mails, etc).
In this case, medical newsletters from consignees not from Clinic may be e-mailed to members to promote national health, not for commercial purposes. For the members who do not agree to receive emails when sign up, of course, the medical news shall not be sent.
(3) However, when a member expresses that he/she does not want to be provided service benefits information, Clinic must exclude the member from the information provision target. And Clinic shall not be responsible for any disadvantages that the member gets from not receiving service information. 
(4) The contents provided in services are rough and general, and they are provided only for delivering information. The information or counselling provided in services can never replace medical diagnosis. The purposes of the information or counselling provided in services are not on substituting medical diagnosis, consultation, or treatment. When a member has any questions or concerns on own health, he/she should get diagnosis from an actual specialist. In any case, it is not recommended to ignore medical diagnosis, or postpone diagnosis, consultation, or treatment due to the information provided in services.

Article 3. Use of Counselling Rooms and Appointment Services
(1) Clinic strives for the best to maintain security so that information related to counselling and appointments of members or users of services is not leaked to the third-parties. However, Clinic is not responsible for the disclosure and loss of counselling in the following cases.
① Where counselling is disclosed due to the leakage of password by the user's carelessness
② Where the user deletes the contents using functions of 'Delete Counselling' or 'Delete Appointment'
③ Where counselling or appointments are disclosed or lost due to the natural disasters or other circumstances beyond the Clinic's control.
(2) Counselling conducted in services may be used for the following purposes after deleting personal information.
① Academic activities
② Authoring activities such as printed materials, CD-ROMs, etc.
③ Part of service contents such as FAQ, recommended counselling, etc.
(3) All or part of counselling service may not be provided for the following cases.
① Where same counselling is requested repeatedly
② Where counselling is requested using expressions defying common sense
③ Where counselling demanding diagnostic names is requested
④ Where counselling on medical expenses, examination expenses, price of medications, etc. is requested
(4) Counselling and appointment services may not be available for 24 hours a day, depending on the personal circumstances of the professionals who respond or process

Article 4. Posts of Members
Clinic may delete the contents posted or registered by members without prior notice when they are deemed as any of the following.
① Where defaming or slandering other members, clinic, or the third-parties
② Where violating public order and good manners and customs
③ Where being deemed to be connected to a criminal act
④ Where violating other rights such as Clinic's copyright, the third-party's copyright, etc.
⑤ Where exceeding posting period prescribed by Clinic
⑥ Where posting obscene materials or linking sexual sites on member's own homepage and bulletin board
⑦ Where not suiting for the nature of the bulletin board
⑧ Where being judged to violate relevant Acts and subordinate statutes

Article 5. Copyright for Materials Posted

The rights for the materials posted in services are as follows.
① The rights and responsibilities for the materials posted are on the publisher and Clinic cannot use them for any profit-making purposes other than posting withing services without consent of the publisher. However, this is not applied for the non-profit cases and Clinic also has the right to post within services.
② Members cannot use the materials posted for any commercial purposes such as processing, selling, etc. information obtained using services.

 Article 6. Insertion of Ads and Transaction with Advertiser
(1) Part of services investment base that Clinic may provide services to members comes from the revenue of insertion of ads. Those who intend to use services are considered to agree to the ads exposed during use of services.
(2) Clinic is not responsible for any of loss or damage caused as a result of members' participation in advertisers' promotional activities posted in services, or communication or transaction with advertisers through services.  

Article 7. Service Hours
(1) Use of services shall be 24 hours a day, all-year in principle unless there are any particular problems on Clinic's business or technology.
(2) Service hours prescribed in the preceding clause may be limited, after notifying members in advance, where Clinic needs for regular system check, etc.

Article 8. Responsibilities for Use of Services
Except where expressly permitted in writing specifically by an authorized employee, members cannot engage any business activities of selling products using services, especially commercial activities through hacking, money-making ads, sexual sites, illegal distribution of commercial software, etc. Clinic is not responsible for the results and loss of business activities, and legal measures such as arrest by related agencies.

Article 9. Suspension of Service Provision, etc.
(1) Clinic may suspend the provision of servives when it deemed as any of followings.
① Where being unavoidable due to construction such as repairing of service facilities, etc.
② Where ceasing of telecommunication services of the key telecommunications service provider prescribed in the Telecommunications Business Act
③ Where being unavoidable reasons 
(2) Clinic may restrict or suspend all or part of services in the event of disruptions to normal use of services due to a national emergency, power outage, failure of service facilities, or congestion of use of services.
(3) When use of services is restricted or suspended in accordance with para 1 and para 2, Clinic shall inform members the reasons, the period of restriction, etc. without delay.

Chapter 5. Termination of Contract and Restriction of Use

Article 1. Termination of Contract
Members may withdraw membership at any time. Secession of membership may be done online directly by clicking 'Withdraw Membership' on the personal information modification page of Clinic's homepage after logging in, or when contacting the person in charge of personal information in writing, with phone call, or via e-mail, personal information will be destroyed without delay.

Article 2. Restriction of Use
Clinic may terminate contract of use or suspend use of services for a fixed period without prior notice when a member commits any of the followings.
① Where stealing another person's personal information, ID and password
② Where registering with false name
③ Where registering more than one ID
④ Where committing any acts that damage other's reputation or penalize 
⑤ Where infringing intellectual property rights of Clinic, other members, or the third-parties
⑥ Where intentionally distributing contents hinderig public order and good manners and customs
⑦ Where planning or executing use of services on the purpose of hindering the national interest or social public interest.
⑧ Where intentionally obstructing the operation of services
⑨ Where transmitting large amount of information or advertising information on the purpose of disrupting the stable operation of services
⑩ Where distributing computer virus programs, etc. that cause malfunction of information and communication facilities or destruction of information
⑪ Where being requested for correction by external agencies such as the Information and Communication Ethics Committee, etc., or obtaining an authoritative interpretation in connection with illegal election campaigns from the National Election Commission
⑫ Where duplication, distributing, or commercially using information obtained by using information of Clinic's services with out Clinic's prior approval
⑬ Where posting obscene materials or linking sexual sites on member's own homepage and bulletin board
⑭ Where violating other conditions prescribed by Clinic, including this agreement

Chapter 6. Compensation for Damage and Exemption

Article 1. Compensation for Damage
(1) When Clinic damages members intentionally or with gross negligence, it is responsible for compensation for the damage.


Article 2. Exemption
(1) When Clinic is unable to provide services due to natural disasters or equivalent force majeure, the responsibility for providing services is exempted.
(2) Clinic is not responsible for failure of use of services due to attributable reasons of members
(3) Clinic is not responsible for the loss of the profit expected by members from using services or damage caused by information obtained through services.
(4) Clinic is not responsible for reliability, accuracy, etc. of information, materials, facts posted by members.
(5) Clinic is not responsible for any damages by subscribers' intention or negligence among damaged occurred to subscribers relalted to use of services.

Article 3. Jurisdiction
When any disputes between Clinic and a member arising out of use of services, sincere discuss will be brought to resolve it. Nevertheless, if a lawsuit is filed against the dispute arising from use of services, it will be brought in any court having jurisdiction over the city in which headquarter of Clinic is located.

Supplementary Provision
1. (Implementation) This agreement will take effect from July 1.

Loving Care Clinic would like to collect and use the following items to provide membership service for online channels(webpage / mobile web, chatbot). Please read the consent carefully and decide whether to agree.
